My father has decided to put step-mom in control over the personal assets and the business properties as well. I am afraid that issues might crop up after his death, and I will lose out on the inheritance as the stepchild. What can I do?

As for what you can do, that’s up to you. It’s you father’s property and if he decides to give it away or names someone else as owner, it’s his call. Unfortunately, you can do nothing about it. However, you can approach your father and discuss about your concerns. You can even suggest that he seeks assistance from an estate-planning attorney.

Yes, your concern is undeniable. If the properties and assets are in your stepmom’s name or in joint tenancy with your father, or if she has the rights of survivorship, those would easily bypass probate. You’ll lose out on the inheritance.
