Your very first step should be to find out the name, address and phone number of the debt collection company that is calling you. Also find out the exact amount they claim from you. Contact the original debt collection company, and confirm whether they have authorized this collection agency to collect debt on their behalf. According to the Fair Debt Collection Practices Act, you have the right to send a debt validation letter to the collection company, who are then obliged to prove that the debt is yours. A debt validation letter is used when the original creditor has assigned or sold the debt to a collection agency. If they have confirmed your debt and if the Statute Of Limitation (SOL) period hasn’t expired, you are legally obliged to pay your debts.
