Yes, disabled veterans might have an upper hand when filing for bankruptcy. Filing for a Chapter 7 is simpler for them. They may not need to take the means test at all to qualify for Chapter 7. A disabled veteran might be allowed to file for Ch-7 even if the means test requires him to file for a Ch-13. This exemption from means test is allowed only if the veteran has been rated with 30% disability or more (by the Veterans Administration), and the debt was incurred by him while on active duty or performing homeland defense activity.
