Settle the debt with Nelson and Kennard collection agency if they can validate it.

Am kind of confused about whom to negotiate with. Borrowed from Capital One, but have now been contacted by Nelson and Kennard, which is supposedly a law firm. If I try for settlement, should I directly approach Capital One or deal with this N & K? Can't afford much for the settlement though.

You should only settle with the one who owns the debt. In this case, if they can prove that they own it, don't delay and try for settlement with N&K only.

Or if you would like to deal with Capital One, call them up and ask them if they're willing to negotiate. But make sure that the creditor owns the debt before you make any payments, since later on if the collection agency is the owner, they may deny the process and you'll still owe the debt.

First ask Nelson and Kennard to validate the debt. They're a collection law firm, and might be acting on behalf of Capital One.
