My present spouse is the co-signer on our daughter’s mortgage. If she’s unable to pay, will my property be at stake in any way?

You’re not the co-signer and will not be held liable directly, if a lawsuit is filed on the loan agreement. However, if your spouse is unable to pay back, the lender may obtain a judgment against her. Consequently, the community property or marital property may be at stake, which is something you wouldn’t want.
