Can I sue the creditor that obtained the judgment and his attorney if they violate the fdcpa?

See, actual creditors are not subject to the FDCPA. Again, the debt must be a consumer debt and the debt collector should be a professional one. Also, if you don’t raise the issue during trial, any defense that was available for you could be waived.
