It is a violation of the FDCPA if they threaten you by wage garnishment but don't intend to do so. They can't garnish without a court order.

I live in florida i bought a car from a buy here pay here and three months later had transmission go out they took the bad car and gave me a loan on a new car now i have the finace company on the other vehicle threatenign to garnish my wages even though they had the car given back to them-can they do that???

There might be some confusion! If they have taken the car back, they should not threaten. My best advice would be to talk to them and clear any confusion that is arising. You can also engage an attorney who has sound experience in determining lending agreements. Hope this helps!
