Can I be arrested for identity fraud?

I received a credit card application for my ex-spouse in the mail. I filled it with my name and social security number along with other information. The credit card company approved and sent me the card. I have been using it for the past year and been regular with the payments too. My ex now says that the payments are showing up on his credit report. Will this be considered as an identity fraud? I never concealed anything in the first place!
