Unfortunately, after Oct 17, 2005, the time limit for filing Chapter 7 once again is eight years fro the discharge date of previous filing.

Few years back, I filed for bankruptcy (it got discharged around 3 years ago) and now because of a massive surgery, I couldn’t able to work now for a year. I am only getting some money from unemployment benefits. Can I once again file for bankruptcy protection?

Unfortunately, after Oct 17, 2005, the time limit for filing Chapter 7 once again is eight years fro the discharge date of previous filing.

However, the time limit for filing Chapter 13 in now four years from the discharge date of a previously filed Chapter 7 and two years from the discharge date of a previously filed Chapter 13.
